Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Fixly website, web application, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You may use Fixly only if you are able to form a binding contract with us and are not prohibited from using the Service under applicable law. The Service is intended for business use by home service professionals and contractors.

2. Account & Security

When you sign in with Google or another identity provider, you are responsible for maintaining the security of your account and for all activity that occurs under your credentials. Notify us immediately of any unauthorized access or suspected breach of security.

3. Description of Service

Fixly provides an AI-powered phone answering and job booking service for home service businesses. The Service includes:

  • AI-powered call answering and job screening.
  • Automated booking to your Google Calendar.
  • SMS notifications and appointment reminders to your customers.
  • Google Review request automation.
  • AI-generated quotes and estimates.

4. Use of Google Data

If you connect your Google account, Fixly may access your Google Calendar and basic profile information strictly for the purpose of booking, updating, and managing jobs on your behalf. We do not sell your Google data to third parties. Our use and transfer of information received from Google APIs will adhere to theGoogle API Services User Data Policy, including the Limited Use requirements.

5. SMS and Communications Consent

By enabling SMS features (reminders, review requests, etc.), you authorize Fixly to send text messages on your behalf to phone numbers you provide or that are collected through the Service. You represent and warrant that:

  • You have obtained proper consent from recipients to receive these messages.
  • You will comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA).
  • You will not use the Service to send spam or unsolicited messages.

Standard message and data rates may apply to recipients. Recipients may opt out by replying STOP to any message.

6. Pricing and Billing

Fixly offers a free tier for core call answering and booking functionality. Optional add-on features are billed on a pay-per-use basis:

  • Smart Calendar Reminders: $1 per reminder sequence.
  • Google Review Automation: $1 per review request sent.
  • AI Quoting: $1 per quote generated.

Charges are billed monthly to your payment method on file. You can view your usage and billing history in your dashboard. All fees are non-refundable except as required by law or at our sole discretion.

7. Payment Processing

Payments are processed securely by Stripe, Inc. By adding a payment method, you agree to Stripe'sTerms of Service. You authorize us to charge your payment method for any fees incurred through your use of the Service. If payment fails, we may suspend access to paid features until payment is resolved.

8. Cancellation

You may cancel your account at any time from your dashboard settings or by contacting us. Upon cancellation:

  • Your Fixly phone number will be released and may be reassigned.
  • Scheduled reminders and automations will be cancelled.
  • You will be billed for any usage incurred prior to cancellation.
  • Your data will be retained for 30 days, then deleted unless legally required otherwise.

9. Acceptable Use

You agree not to misuse the Service, including by attempting to interfere with its normal operation, probing or testing our systems for vulnerabilities, or using Fixly to send spam, abusive, or unlawful communications.

10. Service Changes

We may modify, suspend, or discontinue parts of the Service at any time. Where reasonable, we will provide notice of material changes that may affect you.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Fixly does not guarantee that calls will always be answered or that bookings will be error-free. AI-generated responses may occasionally be inaccurate. You remain responsible for verifying booking details and customer information.

12. Limitation of Liability

To the maximum extent permitted by law, Fixly and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Service. Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months prior to the claim.

13. Indemnification

You agree to indemnify and hold harmless Fixly and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

15. Changes to Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date above. For material changes, we may notify you via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.
